Terms and Conditions – Mi Scend

Valid for sales to consumers in Sweden and the European Union)

1. About Mi Scend

Mi Scend is registered in Sweden, Gothenburg. For any queries, please email miscendcontact@gmail.com and include your name, contact details, and a brief description of your enquiry. We will respond as soon as possible.

2. Orders

When you complete a purchase, an order confirmation will be sent to the e‑mail address you provided. The confirmation includes details of the product(s), price, billing address and delivery address.If you discover an error in your confirmation, you must contact us immediately at miscendcontact@gmail.com

3. Delivery

Normal delivery time in the EU is 3–6 business days.

Orders placed at weekends or on Swedish public holidays are dispatched no earlier than the following business day. 

Unclaimed parcels

An administrative fee of 40 % of the order value (SEK) is charged for parcels that are not collected or are returned to us due to an incorrect address. You are responsible for providing a correct name and delivery address.If you need to change the name or delivery address after dispatch, we can assist for an administrative fee of 449 SEK.

4. Prices

All prices are stated in SEK and include Swedish VAT (moms). We reserve the right to adjust prices due to supplier price changes, misprints, or incorrect information. 

5. Right of Withdrawal (Cancellation)

As an EU consumer you have a statutory 14‑day right of withdrawal (Directive 2011/83/EU and Swedish Distance Contracts Act). The withdrawal period starts on the day you receive the product.

5.1 How to exercise your right

Notify us within 14 days by e‑mailing miscendcontact@gmail.com. State your name, address, e‑mail, order number and which items you wish to return.

Return the products to us without undue delay and no later than 14 days after your withdrawal notice.

You are responsible for return shipping costs, the condition of the goods during return transport, and should therefore send the goods well‑packed and in their original packaging.

Refunds are made only to the original method and source of payment.

We may deduct an amount corresponding to any decrease in the value of the goods caused by handling beyond what is necessary to determine the nature, characteristics and functioning of the goods.

5.2 Exceptions

The right of withdrawal does not apply to:

Goods that cannot be resold for health or hygiene reasons once they have been used (e.g. products that have been inflated).

Goods sealed for health or hygiene reasons where the seal has been broken.

Audio or video recordings or computer software with broken seals.

Custom‑made or clearly personalised items.

Services that have been fully performed and to which you have expressly consented to begin during the withdrawal period.

Goods that can deteriorate rapidly (e.g. perishable food).

Single issues of newspapers or magazines.

For further information on statutory withdrawal rights, see the Swedish Consumer Agency (konsumentverket.se) or your national consumer authority.

6. Complaints

Should the product be damaged or incorrect on arrival, we will, in accordance with applicable consumer protection law, remedy the defect at no cost to you. Always contact us for approval before returning a defective item. The complaint must be made as soon as possible after the defect has been discovered.

6.1 Complaint procedure

Send an e‑mail to miscendcontact@gmail.com with your name, address, e‑mail, order number and a description of the defect. If we cannot rectify the defect or deliver a replacement, we will refund you for the defective product in accordance with consumer law. Return shipping for approved complaints is at your expense. We reserve the right to refuse a complaint if the product proves not to be defective under applicable law. In disputes we follow the recommendations of the Swedish National Board for Consumer Disputes (ARN) – arn.se.

7. Limitation of Liability

We accept no liability for indirect damage that may arise from the product. We are not responsible for delays or errors caused by circumstances beyond our control (force majeure), such as labour disputes, fire, war, governmental action, reduced or non‑delivery from suppliers, or similar events. Nor are we responsible for changes to products or product characteristics made by suppliers or other factors beyond our control.

8. Product Information

We reserve the right for any typographical errors on this website and for sold‑out products. We cannot guarantee that the images reflect the exact appearance of the products, as colour differences may occur depending on your screen, photo quality and resolution. We always strive to display the products as accurately as possible.

9. Personal Data (GDPR)

By shopping with Mi Scend you accept our privacy policy and our processing of your personal data. We respect your privacy and collect only information necessary to process your order. We never sell or disclose your data to third parties without legal basis.

Mi Scend is the data controller for the processing of personal data you provide as a customer. Your data is processed to manage your order and, where you have requested newsletters or promotional offers, to personalise marketing.

9.1 What is personal data?

Personal data means any information that can be linked directly or indirectly to a natural person.

9.2 What data do we store?

To manage your order and customer service enquiries we store your first and last name, address, telephone number, e‑mail address, IP address and purchase history. Your data is stored as long as we have a legal basis, for example to fulfill our agreement with you or to comply with accounting legislation.

9.3 Legal basis

When you make a purchase, we process your personal data to fulfill the contract with you. Marketing, campaigns and similar mailings are sent after you have given your consent.

9.4 Which data are shared and why?

9.4.1 Payment providers – When completing a purchase, data is shared with our payment provider. Stored data: first name, last name, address, e‑mail, telephone, and, if you pay by invoice, personal identity number. The information is stored to complete the purchase and protect against fraud. Payment providers: Klarna, Visa, Mastercard.

9.4.2 Shipping companies – To deliver your orders, we share certain data with the shipping company: First name, last name, delivery address, and, where applicable, e‑mail and/or mobile number for notifications.

9.4.3 Newsletters – If you subscribe to our newsletter, we share first name, last name and e‑mail with our newsletter provider to keep you updated with offers and information.

9.5 Right of access

You have the right to receive an extract of all information we hold about you. The extract is delivered electronically in a readable format.

9.6 Right to rectification

You have the right to ask us to update inaccurate information or complete information that is incomplete.

9.7 Right to be forgotten

You can request deletion of your data at any time. Exceptions include data we are required to keep to fulfil a legal obligation (e.g. the Accounting Act).

10.8 Data protection officer

Mi Scend is responsible for the storage and processing of personal data in the webshop and ensures compliance with the regulations.

11. Amendments to the Terms and Conditions

We reserve the right to change these terms at any time. Changes will be published online on the website. The amended terms are considered accepted in connection with new orders or visits to the site.

12. Dispute Resolution and Governing Law

If a dispute cannot be resolved in agreement with Mi Scend's customer service, you can contact the Swedish National Board for Consumer Disputes (ARN). Residents of another EU country can submit complaints online via the European Commission’s ODR platform: http://ec.europa.eu/consumers/odr.We follow the decisions of ARN or equivalent dispute resolution bodies.Disputes regarding the interpretation or application of these terms shall be governed by Swedish law.
